I.-Prior to the conclusion of any insurance contract, the distributor referred to in Article L. 511-1 shall specify in writing, on the basis of information obtained from the prospective subscriber or member, the latter’s requirements and needs and shall provide him with objective information on the proposed insurance product in a comprehensible, accurate and non-misleading form in order to enable him to make an informed decision.
The distributor shall advise on a contract that is consistent with the requirements and needs of the prospective subscriber or member and shall specify the reasons for this advice.
II. -Without prejudice to the provisions of I, prior to the conclusion of a specific contract, where the insurance distributor offers the prospective policyholder or member a personalised recommendation service, this service consists of explaining why, among several contracts or several options within a contract, one or several contracts or options best correspond to his requirements and needs.
III. -The details referred to in I and II of this article and in article L. 522-5, which are based in particular on the information provided by the prospective policyholder or member, are adapted to the complexity of the insurance contract offered. These details are communicated to the prospective policyholder or member in a comprehensible, accurate and non-misleading form to enable them to understand the consistency of the proposed contract with their requirements and needs and to make a fully informed decision.
IV – Prior to taking out or subscribing to a contract referred to in article L. 522-1, the distributor must comply with the provisions of article L. 522-5, notwithstanding I and II of this article.
