Where it is expressly authorised to do so by its articles of association, a public establishment for inter-municipal cooperation may request to exercise, in the name and on behalf of the department or the region, all or part of the competences devolved to one or other of these authorities.
The president of the regional council or the departmental council is required to place the consideration of a request to this effect on the agenda of the deliberative assembly within six months.
The deliberative assembly decides on this request in a reasoned deliberation.
The exercise by the public establishment of inter-communal cooperation of such competence is the subject of an agreement concluded between the establishment and the département or region, which determines the extent of the delegation, its duration as well as its financial terms and conditions of execution. This agreement specifies the conditions for sharing the responsibilities incurred under the delegation, without prejudice to the rights of third parties.
The application of this article does not entail any right to termination or compensation for the co-contractors of the local authority delegating its competence.
