Article L5211-1 of the French General Code of Local Authorities

The provisions of Chapter I of Title II of Book I of Part Two relating to the operation of the municipal council are applicable to the operation of the deliberative body of public establishments for inter-municipal cooperation, insofar as they are not contrary to the provisions of this Title.

For the application of the provisions of articles L. 2121-8, L. 2121-9, L. 2121-19 and L. 2121-22 and L2121-27-1,these establishments are subject to the rules applicable to municipalities with 1,000 or more inhabitants.

For the application of articles L. 2121-11 and L. 2121-12, these establishments are subject to the rules applicable to communes of 3,500 inhabitants or more.

Article L. 2121-22-1 applies to public establishments for intercommunal cooperation with a population of 20,000 or more.

For the application of article L. 2121-4, the resignation of a member of the deliberative body of public establishments of inter-communal cooperation is addressed to the president. The resignation is final as soon as it is received by the chairman, who immediately informs the mayor of the commune from which the resigning member comes.

Les dispositions du chapitre Ier du titre II du livre Ier de la deuxième partie relatives au fonctionnement du conseil municipal sont applicables au fonctionnement de l’organe délibérant des établissements publics de coopération intercommunale, en tant qu’elles ne sont pas contraires aux dispositions du présent titre.

Pour l’application des dispositions des articles L. 2121-8, L. 2121-9, L. 2121-19 et L. 2121-22 et L2121-27-1, ces établissements sont soumis aux règles applicables aux communes de 1 000 habitants et plus.

Pour l’application des articles L. 2121-11 et L. 2121-12, ces établissements sont soumis aux règles applicables aux communes de 3 500 habitants et plus.

L’article L. 2121-22-1 s’applique aux établissements publics de coopération intercommunale regroupant une population de 20 000 habitants ou plus.

Pour l’application de l’article L. 2121-4, la démission d’un membre de l’organe délibérant des établissements publics de coopération intercommunale est adressée au président. La démission est définitive dès sa réception par le président, qui en informe immédiatement le maire de la commune dont le membre démissionnaire est issu.
