Article L5211-3 of the French General Code of Local Authorities

The provisions of Chapter One of Title III of Book One of Part Two relating to the control of legality and the publication and entry into force of the acts of communes are applicable to public establishments for inter-municipal cooperation. The transmission of acts by electronic means provided for in article L. 2131-1 is only mandatory for public establishments for inter-municipal cooperation with their own tax status within five years of the promulgation of the loi n° 2015-991 du 7 août 2015 portant nouvelle organisation territoriale de la République.

For the application of article L. 2131-1, public establishments for intercommunal cooperation with their own tax status are subject only to the provisions of I, II, III, V and VI of that article and syndicates of communes only to the provisions of I, II, IV, V and VI of that same article.

Les dispositions du chapitre premier du titre III du livre premier de la deuxième partie relatives au contrôle de légalité et à la publicité et à l’entrée en vigueur des actes des communes sont applicables aux établissements publics de coopération intercommunale. La transmission des actes par voie électronique prévue à l’article L. 2131-1 n’est obligatoire que pour les établissements publics de coopération intercommunale à fiscalité propre dans un délai de cinq ans à compter de la promulgation de la loi n° 2015-991 du 7 août 2015 portant nouvelle organisation territoriale de la République.

Pour l’application de l’article L. 2131-1, les établissements publics de coopération intercommunale à fiscalité propre ne sont soumis qu’aux dispositions des I, II, III, V et VI de cet article et les syndicats de communes qu’aux dispositions des I, II, IV, V et VI de ce même article.
