Article L5211-4-4 of the French General Code of Local Authorities

I.-When a grouping of orders is set up between communes that are members of the same public establishment for inter-communal cooperation with their own tax status or between these communes and this public establishment, the communes may entrust this public establishment, free of charge, by agreement, if the articles of association of the public establishment expressly so provide, independently of the functions of coordinator of the grouping of orders and whatever the competences that have been transferred to it, with the responsibility of carrying out all or part of the procedure for awarding or executing one or more public contracts in the name and on behalf of the members of the grouping.

II.-When a grouping of orders is set up between communes located on the territory of the Lyon metropolitan authority or between these communes and this metropolitan authority, the communes may entrust to the latter, free of charge, by agreement, independently of the functions of coordinator of the grouping of orders and whatever the competences available to the metropolitan authority, the responsibility of carrying out all or part of the procedure for awarding or executing one or more public contracts in the name and on behalf of the communes that are members of the grouping.

I.-Lorsqu’un groupement de commandes est constitué entre des communes membres d’un même établissement public de coopération intercommunale à fiscalité propre ou entre ces communes et cet établissement public, les communes peuvent confier à titre gratuit à cet établissement public, par convention, si les statuts de l’établissement public le prévoient expressément, indépendamment des fonctions de coordonnateur du groupement de commandes et quelles que soient les compétences qui lui ont été transférées, la charge de mener tout ou partie de la procédure de passation ou de l’exécution d’un ou de plusieurs marchés publics au nom et pour le compte des membres du groupement.

II.-Lorsqu’un groupement de commandes est constitué entre des communes situées sur le territoire de la métropole de Lyon ou entre ces communes et cette métropole, les communes peuvent confier à cette dernière, à titre gratuit, par convention, indépendamment des fonctions de coordonnateur du groupement de commandes et quelles que soient les compétences dont la métropole dispose, la charge de mener tout ou partie de la procédure de passation ou de l’exécution d’un ou de plusieurs marchés publics au nom et pour le compte des communes membres du groupement.
