Article L5312-13-1 of the French Labour Code

Within Pôle emploi, fraud prevention officers are sworn in and approved under conditions defined by order of the Minister for Employment. In the event of an infringement of the provisions of this code falling within the remit of the aforementioned institution, these agents are authorised to draw up official reports, which are valid until proven otherwise. They shall forward them to the public prosecutor for prosecution in the case of offences punishable under criminal law.

Obstructing the performance of the duties of the agents mentioned in the first paragraph, whatever their field of action, is punishable by six months’ imprisonment and a fine of €7,500.

Au sein de Pôle emploi, des agents chargés de la prévention des fraudes sont assermentés et agréés dans des conditions définies par arrêté du ministre chargé de l’emploi. Ces agents ont qualité pour dresser, en cas d’infraction aux dispositions du présent code entrant dans le champ de compétence de ladite institution, des procès-verbaux faisant foi jusqu’à preuve du contraire. Ils les transmettent, aux fins de poursuite, au procureur de la République s’il s’agit d’infractions pénalement sanctionnées.

Le fait de faire obstacle à l’accomplissement des fonctions des agents mentionnés au premier alinéa, quel que soit leur cadre d’action, est puni de six mois d’emprisonnement et de 7 500 € d’amende.
