Article L5312-13 of the French Labour Code

The immovable property of the institution mentioned in Article L. 5312-1 is entirely in its private domain. Property transferred to the institution shall be decommissioned if it belongs to the public domain. When a work or land belonging to the institution is necessary for the proper performance of its public service missions or for the development of these missions, the State may oppose its transfer, its contribution, in any form whatsoever, or the creation of a security interest over this work or land, or make the transfer, the contribution or the creation of the security interest subject to the condition that it is not likely to prejudice the performance of these missions. Any transfer, contribution or creation of security interest carried out without the State having been given the opportunity to object, in breach of its objection or in disregard of the conditions set for the completion of the transaction, is automatically null and void.

Les biens immobiliers de l’institution mentionnée à l’article L. 5312-1 relèvent en totalité de son domaine privé. Sont déclassés les biens immobiliers qui lui sont transférés, lorsqu’ils appartiennent au domaine public. Lorsqu’un ouvrage ou terrain appartenant à l’institution est nécessaire à la bonne exécution de ses missions de service public ou au développement de celles-ci, l’Etat peut s’opposer à sa cession, à son apport, sous quelque forme que ce soit, à la création d’une sûreté sur cet ouvrage ou terrain, ou subordonner la cession, la réalisation de l’apport ou la création de la sûreté à la condition qu’elle ne soit pas susceptible de porter préjudice à l’accomplissement de ces missions. Est nul de plein droit tout acte de cession, apport ou création de sûreté réalisé sans que l’Etat ait été mis à même de s’y opposer, en violation de son opposition ou en méconnaissance des conditions fixées à la réalisation de l’opération.
