Article L5315-8 of the French Labour Code

Training bodies accredited under article L. 6121-2-1 have access to the premises and facilities of the public institution under objective, transparent and non-discriminatory conditions, in accordance with the terms and conditions set out in an agreement signed by the State, the region and the public institution.

This agreement is in line with the coordinated strategy of the region and the State provided for in article L. 6123-4-1.

This agreement is entered into in compliance with a set of specifications defined by decree in the Conseil d’Etat, which in particular sets the terms and conditions for the payment by the beneficiary organisation to the public institution of a fee for services rendered. This fee is set on the basis of the cost of maintaining and operating the facilities, after deduction of the costs associated with the property assets referred to in Article L. 5315-7.

Les organismes de formation bénéficiant d’une habilitation au titre de l’article L. 6121-2-1 ont accès aux locaux et équipements de l’établissement public dans des conditions objectives, transparentes et non discriminatoires, selon des modalités fixées par une convention signée entre l’Etat, la région et l’établissement public.


Cette convention est conforme à la stratégie coordonnée de la région et de l’Etat prévue à l’article L. 6123-4-1.


Cette convention est conclue dans le respect d’un cahier des charges défini par décret en Conseil d’Etat qui fixe notamment les modalités du versement par l’organisme bénéficiaire à l’établissement public d’une redevance pour service rendu. Cette redevance est fixée en fonction du coût d’entretien et de fonctionnement des installations, après déduction des coûts liés aux actifs immobiliers mentionnés à l’article L. 5315-7.
