Article L6433-5 of the French General Code of Local Authorities

The employer is required to allow any employee of his company who is a member of the territorial council the time necessary to travel to and participate in:

1° The plenary sessions of this council;

2° The meetings of the committees of which he is a member and set up by a deliberation of the territorial council;

3° The meetings of the deliberative assemblies and the boards of the bodies where he has been appointed to represent the local authority.

In accordance with procedures laid down by a decree in the Conseil d’Etat, the elected representative must inform the employer of the date of the session or meeting as soon as he is aware of it.

The employer is not obliged to pay as working time the time spent by the elected representative at the aforementioned sessions and meetings.

L’employeur est tenu de laisser à tout salarié de son entreprise membre du conseil territorial le temps nécessaire pour se rendre et participer :

1° Aux séances plénières de ce conseil ;

2° Aux réunions des commissions dont il est membre et instituées par une délibération du conseil territorial ;

3° Aux réunions des assemblées délibérantes et des bureaux des organismes où il a été désigné pour représenter la collectivité.

Selon des modalités fixées par un décret en Conseil d’Etat, l’élu doit informer l’employeur de la date de la séance ou de la réunion dès qu’il en a connaissance.

L’employeur n’est pas tenu de payer comme temps de travail le temps passé par l’élu aux séances et réunions précitées.
