The president of the assembly of French Guyana, the vice-presidents or the councillors who have been delegated benefit, on the occasion of their duties, from protection organised by the territorial collectivity in accordance with the rules laid down by the penal code, special laws and this code.
The territorial collectivity of French Guiana is obliged to protect the president of the assembly of French Guiana, the vice-presidents or the councillors who have been delegated against violence, threats or insults of which they may be the victims in the course of their duties and to compensate, where appropriate, for any resulting damage.
The local authority is subrogated to the rights of the victim to obtain from the perpetrators of these offences the restitution of the sums paid to the elected representative concerned. It also has a direct action for the same purposes, which it may bring, if necessary by bringing a civil action, before the criminal court.
