The Autorité des relations sociales des plateformes d’emploi is a national public administrative body under the supervision of the Minister for Labour and the Minister for Transport.
Its mission is to regulate social dialogue between the platforms referred to in Article L. 7342-1 and the employees bound to them by a commercial contract, in particular by ensuring the dissemination of information and promoting consultation.
To this end, it is responsible for:
1° Determining, under the conditions set out in Article L. 7343-4 and Article L. 7343-24, the list of organisations representing employees by organising the ballot referred to in Article L. 7343-5 and the audience measurement referred to in 6° of Article L. 7343-22 ;
2° To ensure the financing of the training courses referred to in Article L. 7343-19 and the compensation for training days and delegation hours referred to in Article L. 7343-20 ;
3° Promoting the development of social dialogue with employee and platform representatives and supporting them in implementing sector negotiation rules and organising election cycles;
4° Authorising the termination of commercial relations between platforms and employees with a representation mandate under the conditions set out in Article L. 7343-14 ;
5° Collecting statistics, transmitted by the platforms, relating to the activity of the platforms and their workers, excluding personal data relating to customers and in compliance with Act No. 78-17 of 5 January 1978 on Data Processing, Data Files and Individual Liberties, under conditions set by decree, in order to produce studies and statistical reports, with a view to making them available to the representative organisations;
6° Examining applications for approval of sector agreements;
7° Proposing mediation in the event of a dispute between one or more self-employed workers and the platforms, under the conditions laid down in Article L. 7345-7;
8° Ruling on requests for expert opinions, under the conditions laid down in Section 6 of Chapter IV of this Title;
9° Observing the practices of platforms relating to the conditions under which workers carry out their professional activities, particularly with regard to the use of algorithms, digital tools and workers’ personal data, conducting surveys or studies and issuing opinions and recommendations on these subjects.
