To be authorised to carry out organ removal for therapeutic purposes on a deceased person, health establishments must:
1° Have the staff and equipment necessary to establish the fact of death, under the conditions defined in Chapter II of this Title;
2° Demonstrate that their organisation and operating conditions allow for the satisfactory performance of removal operations;
3° Appoint a coordinating doctor for the removal activity, after consultation with the establishment’s medical advisory body and one or, where appropriate, hospital nurse coordinators; the list of these persons is communicated to the health establishment’s decision-making body;
4° It must have the medical staff and other personnel required to carry out the sampling activity, and at least, on continuous duty, a doctor specialising in anaesthesiology and surgical intensive care, or a qualified doctor specialising in anaesthesia and intensive care, or a competent doctor qualified in anaesthesia and intensive care or intensive care, or a doctor holding a diploma of complementary specialised studies in medical intensive care;
5° Have the premises required to carry out this activity, and at least :
a) A room suitable for receiving families ;
b) An area for donor isolation, easily accessible to families, belonging to a service, department, unit or structure that does not perform transplants, equipped with the necessary equipment for respiratory and circulatory management of donors;
c) An operating theatre equipped with the necessary equipment and of sufficient size to carry out organ explantation and the decent restoration of the donor’s body.
