Article R134-2 of the French Insurance Code

The premiums and amounts arbitrated or transferred net of charges provided for in 1° of article R. 134-3 give rise to individual rights expressed in terms of the number of units in the diversification provision and, in the case of commitments covered by 1° of article L. 134-1, in terms of the mathematical provision.

The number of units in the diversification provision is obtained by dividing the diversification provision by the value of the unit common to all commitments.

For commitments covered by 1° of Article L. 134-1, the mathematical provision is equal to the amount of the forward guarantee discounted at a rate defined by order of the Minister for the Economy.

Article R134-2

Les primes et les montants arbitrés ou transférés nets de frais prévus au 1° de l’article R. 134-3 ouvrent des droits individuels exprimés en nombre de parts de provision de diversification et, s’agissant des engagements relevant du 1° de l’article L. 134-1, en provision mathématique.

Le nombre de parts de provision de diversification est obtenu en divisant la provision de diversification par la valeur de la part, commune à l’ensemble des engagements.

Pour les engagements relevant du 1° de l’article L. 134-1, la provision mathématique est égale au montant de la garantie à terme actualisée à un taux défini par arrêté du ministre chargé de l’économie.
