Votes for the election of representatives of the communes and public establishments for inter-municipal cooperation are counted by the commission set up in article 18 of the décret n° 96-1005 du 22 novembre 1996 relatif à l’installation des premiers conseils d’administration des services départementaux d’incendie et de secours.
A representative of each list may monitor the ballot counting operations.
In the event of a tie in the allocation of the last seat remaining to be filled, this seat goes to the list that obtained the highest number of votes. In the event of a tie, the election is won by the oldest candidate eligible for election.
The results are announced, posted and published by the chairman of the committee. They may be contested before the administrative court, within ten days of their proclamation, by any elector, by any candidate and by the prefect.
When a candidate is elected simultaneously to the first board of directors and to the departmental advisory commission, he or she has a period of eight days from the proclamation of the results in which to make his or her choice known to the vote-counting commission.If no option is made within the time allowed, the candidate’s election is acquired by the board of directors.
Where a seat remains to be filled on the departmental advisory commission, this seat is allocated to the first non-elected candidate on the same list.
Where a seat remains to be filled on the first board of directors, this seat is allocated to the alternate of the candidate concerned in accordance with article 19 of the aforementioned decree no. 96-1005 of 22 November 1996.
