Article R211-42 of the French Insurance Code

The third party payer shall indicate to the insurer, for each sum for which he is claiming reimbursement, the legislative, regulatory or contractual provision under which this sum is due to the victim.

In the case provided for in the third paragraph of Article L. 211-11, the amounts claimed are provisional only if the third party payer expressly states this.

Le tiers payeur indique à l’assureur pour chaque somme dont il demande le remboursement la disposition législative, réglementaire ou conventionnelle en vertu de laquelle cette somme est due à la victime.

Dans le cas prévu au troisième alinéa de l’article L. 211-11, les créances réclamées n’ont un caractère provisionnel que si le tiers payeur le précise expressément.
