Article R2122-16 of the French Labour Code

The files compiled from the data mentioned in article R. 2122-12 are kept by the departments of the Minister for Labour for a period of one year after the close of the poll for which the files were compiled. After this period, the files are transferred to the national archives.

These departments may, however, keep a copy of extracts from the anonymised files with a view to carrying out experiments for subsequent ballots.

Les fichiers constitués à partir des données mentionnées à l’article R. 2122-12 sont conservés par les services du ministre chargé du travail pendant une durée d’un an après la clôture du scrutin en vue duquel ces fichiers ont été réalisés. Passé ce délai, les fichiers sont versés aux archives nationales.

Ces services peuvent toutefois conserver une copie d’extraits des fichiers rendus anonymes en vue de réaliser des expérimentations pour les scrutins suivants.
