Article R2123-4 of the French General Code of Local Authorities

The provisions of Article R. 2123-3 are applicable, where they do not benefit from more favourable provisions, to civil servants governed by Titles I to IV of the general civil service regulations and to contractual employees of the State, local authorities and their public administrative establishments who hold elective public office.

These provisions are also applicable to serving military personnel who hold elective public office, subject to the requirements linked to the preparation and conduct of operations and the proper execution of the missions of the armed forces and attached formations; the elected military personnel shall inform their hierarchical authority in writing at least seven days before their absence, specifying the date and duration of the planned absence.

Article R2123-4

Les dispositions de l’article R. 2123-3 sont applicables, lorsqu’ils ne bénéficient pas de dispositions plus favorables, aux fonctionnaires régis par les titres 1er à IV du statut général de la fonction publique ainsi qu’aux agents contractuels de l’Etat, des collectivités territoriales et de leurs établissements publics administratifs qui exercent des fonctions publiques électives.

Ces dispositions sont également applicables aux militaires en position d’activité qui exercent des fonctions publiques électives, sous réserve des nécessités liées à la préparation et à la conduite des opérations ainsi qu’à la bonne exécution des missions des forces armées et formations rattachées ; le militaire élu informe son autorité hiérarchique par écrit sept jours au moins avant son absence, en précisant la date et la durée de l’absence envisagée.
