Article R220-3 of the French Insurance Code

Notwithstanding the foregoing provisions, the obligation to take out insurance does not apply to compensation for :

a) Damage caused to the operator, to its representatives if it is a legal entity and, during their service, to the employees or agents of the operator as well as to the personnel of the inspection services ;

b) Damage resulting from the direct or indirect effects of an explosion, the release of heat, irradiation resulting from the transmutation of atomic nuclei or radioactivity, as well as the effects of radiation caused by the artificial acceleration of particles;

c) Damage caused by acts of terrorism or sabotage committed as part of concerted actions of terrorism or sabotage.

Par dérogation aux dispositions qui précèdent, l’obligation d’assurance ne s’applique pas à la réparation :

a) Des dommages causés à l’exploitant, à ses représentants s’il est une personne morale et, pendant leur service, aux salariés ou préposés de l’exploitant ainsi qu’au personnel des services de contrôle ;

b) Des dommages résultant des effets directs ou indirects d’explosion, de dégagement de chaleur, d’irradiation provenant de transmutation de noyaux d’atomes ou de radioactivité, ainsi que des effets de radiations provoquées par l’accélération artificielle de particules ;

c) Des dommages causés par les actes de terrorisme ou de sabotage commis dans le cadre d’actions concertées de terrorisme ou de sabotage.
