Article R2212-12-1 of the French Public Health Code

To allow a doctor in the health centre to carry out voluntary terminations of pregnancy by the instrumental method under local anaesthetic, the health centre must meet the following conditions:

1° Have signed the agreement mentioned in 2° of article R. 2212-9 with a health establishment authorised in gynaecology-obstetrics;

2° Guarantee the conditions of hygiene, quality and safety of care in accordance with the specifications of the Haute Autorité de santé provided for in article L. 6323-1-1 and the availability of an emergency trolley, the composition of which is set by order of the Minister in charge of health;

3° Identify the volunteer doctor(s) in the health centre who meet the conditions set out in II of article R. 2212-11, as well as the health professionals who volunteer to provide their assistance, and organise the procedures guaranteeing the presence on the premises, during the operation, of at least one of these health professionals, other than the doctor performing the operation;

4° Organise an appropriate course of treatment for the woman concerned, enabling the confidentiality requirement laid down in Article L. 2212-10 to be respected and providing in particular for :

the possibility of being accompanied by the person of her choice;

-information on all the methods of voluntary interruption of pregnancy and referral, if she so wishes, to a partner establishment providing the same procedures under general or loco-regional anaesthetic;

her monitoring in the period immediately following the operation and verification of the criteria allowing her to be discharged;

-in the event of a complication, the first emergency response by healthcare professionals trained in the management of such situations and the organisation of her rapid and appropriate transfer to the partner healthcare facility, if necessary by calling the SAMU;

-providing the patient, along with the discharge prescription, with an information document specifying the symptoms justifying an emergency referral, with a telephone number and the contact details of the partner hospital, as well as the liaison form provided for in article R. 2212-15.

Article R2212-12-1

Pour permettre à un médecin du centre de santé de réaliser des interruptions volontaires de grossesse par la méthode instrumentale sous anesthésie locale, le centre de santé doit répondre aux conditions suivantes :

1° Avoir signé la convention mentionnée au 2° de l’article R. 2212-9 avec un établissement de santé autorisé en gynécologie-obstétrique ;

2° Garantir les conditions d’hygiène, de qualité et de sécurité des soins conformes au cahier des charges de la Haute Autorité de santé prévu à l’article L. 6323-1-1 et la disponibilité d’un chariot d’urgence dont la composition est fixée par arrêté du ministre chargé de la santé ;

3° Identifier le ou les médecins volontaires du centre de santé qui remplissent les conditions prévues au II de l’article R. 2212-11 ainsi que les professionnels de santé volontaires pour apporter leur concours, et organiser les modalités garantissant la présence dans les locaux, pendant l’intervention, d’au moins l’un de ces professionnels de santé, autre que le médecin pratiquant l’intervention ;

4° Organiser un parcours adapté de prise en charge de la femme concernée, permettant de respecter l’exigence de secret prévue par l’article L. 2212-10 et prévoyant notamment :

-la possibilité de se faire accompagner par la personne de son choix ;

-son information sur l’ensemble des modalités d’interruption volontaire de grossesse et son orientation, si elle le souhaite, vers l’établissement partenaire assurant les mêmes interventions par anesthésie générale ou loco-régionale ;

-sa surveillance dans la période qui suit immédiatement l’intervention et la vérification des critères permettant sa sortie ;

-en cas de complication, la première réponse en urgence par des professionnels de santé formés à la gestion de ces situations et l’organisation de son transfert rapide et adapté vers l’établissement de santé partenaire, le cas échéant par appel du SAMU ;

-la remise à son attention, avec l’ordonnance de sortie, d’un document d’information précisant les symptômes justifiant un recours en urgence avec un numéro d’appel et les coordonnées de l’hôpital partenaire, ainsi que de la fiche de liaison prévus à l’article R. 2212-15.
