To qualify for approval for the application of article L. 2212-4, the organisations mentioned in 4° of article R. 2212-1 must satisfy the following conditions:
1° They must be managed by a legal person governed by public law or by a legal person governed by private law with a non-profit-making aim and a social purpose ;
2° Have premises suitable for the type of maintenance provided for in article L. 2212-4 ;
3° Have staff available for consultations who have the necessary skills and experience and who have not been convicted of acts contrary to honour, probity or morality, or of an offence under articles 226-13 and 226-14 of the Criminal Code, Title II of this Book and Chapter IV of Title III of Book IV of Part V of this Code;
4° Undertake to ensure that consultations take place at least once a week.
