Article R2213-40 of the French General Code of Local Authorities

Any request for exhumation must be made by the next of kin of the deceased. The latter must provide proof of his or her civil status, domicile and the capacity in which he or she is making the request.

Authorisation to exhume a body is issued by the mayor of the commune where the exhumation is to take place.

The exhumation is carried out in the presence of a relative or a representative of the family.

If the duly notified relative or proxy is not present at the specified time, the operation does not take place.

Toute demande d’exhumation est faite par le plus proche parent de la personne défunte. Celui-ci justifie de son état civil, de son domicile et de la qualité en vertu de laquelle il formule sa demande.

L’autorisation d’exhumer un corps est délivrée par le maire de la commune où doit avoir lieu l’exhumation.

L’exhumation est faite en présence d’un parent ou d’un mandataire de la famille.

Si le parent ou le mandataire dûment avisé n’est pas présent à l’heure indiquée, l’opération n’a pas lieu.
