Article R222-38 of the French Sports Code

In the event of a breach of the provisions of articles L. 222-5, L. 222-7 to L. 222-18, R. 222-20, R. 222-31 and R. 222-32 as well as the provisions of the sports agents’ regulations issued on the basis of article L. 222-18, impose the following sanctions on sports agents:

1° A warning;

2° A financial penalty which may not exceed the amount of the fines provided for 5th class offences;

3° Temporary suspension of the sports agent’s licence;

4° Withdrawal of the sports agent’s licence, possibly accompanied by a ban on obtaining another licence in the same discipline or in any discipline for a period of up to five years.

For the sports agents mentioned in article R. 222-28, the sanctions provided for in 3° and 4° are replaced by a ban on exercising the activity of sports agent in France for a period of up to five years.

The sanctions mentioned in 2°, 3° and 4° of this article may be suspended. The suspended sanction is revoked if a new breach is committed within five years of the sanction being imposed.

The sanctions mentioned in 1°, 3° and 4° of this article may be combined with the sanction mentioned in 2°.

Article R222-38

La commission des agents sportifs peut, en cas de violation des dispositions des articles L. 222-5, L. 222-7 à L. 222-18, R. 222-20, R. 222-31 et R. 222-32 ainsi que des dispositions du règlement des agents sportifs édictées sur le fondement de l’article L. 222-18, prononcer à l’égard des agents sportifs les sanctions suivantes :

1° Un avertissement ;

2° Une sanction pécuniaire qui ne peut excéder le montant des amendes prévues pour les contraventions de la 5e classe ;

3° La suspension temporaire de la licence d’agent sportif ;

4° Le retrait de la licence d’agent sportif, éventuellement assorti de l’interdiction d’obtenir une autre licence dans la même discipline ou dans toute discipline pour une durée pouvant aller jusqu’à cinq ans.

Pour les agents sportifs mentionnés à l’article R. 222-28, les sanctions prévues aux 3° et 4° sont remplacées par l’interdiction d’exercer l’activité d’agent sportif en France pour une durée pouvant aller jusqu’à cinq ans.

Les sanctions mentionnées aux 2°, 3° et 4° du présent article peuvent être assorties du sursis. Le sursis est révoqué si un nouveau manquement est commis dans un délai de cinq ans à compter du prononcé de la sanction.

Les sanctions mentionnées aux 1°, 3° et 4° du présent article peuvent être cumulées avec la sanction mentionnée au 2°.
