Disciplinary proceedings are initiated by the Delegate for Sports Agents, who investigates the case in accordance with the adversarial principle. The person being prosecuted is notified of the complaints, given a period in which to respond and may consult the entire case file before the hearing.
The defendant is summoned to the hearing. They may be represented by a lawyer or assisted by one or more persons of their choice. The accused may request that persons of his choice be heard. The Chairman may reject abusive requests to be heard.
Proceedings before the Sports Agents’ Committee hearing disciplinary matters are public. However, the Chairman may, on his own initiative or at the request of the person being prosecuted, prohibit access to the room for all or part of the hearing in the interests of public order or when this is justified by respect for privacy.
The committee deliberates in camera, without the presence of the person being prosecuted, their defenders, the persons heard at the hearing and the sports agents’ representative. It reaches its decision in a reasoned decision that is notified to the person concerned.
