I.-When 1° of II of article L. 2223-18-1-1, the crematorium operator shall pay the proceeds from the sale of metals recovered after cremation to one or more communes, which may only allocate the corresponding sum to covering the funeral expenses of persons without sufficient resources.
II.-The donation referred to in 2° of II of Article L. 2223-18-1-1 may only be made to an association of general interest or a foundation recognised as being in the public interest, appearing on a list drawn up by the deliberative body of the municipality or public establishment of inter-municipal cooperation competent for the creation and management of the crematorium.
Where the crematorium is subject to delegated management, the municipality or establishment for inter-municipal cooperation consults the delegatee prior to the deliberation establishing this list.
III.-The provisions of I and II of article L. 2223-18-1-1 are reproduced in the cremation estimate. These provisions also appear, where applicable, in the contract providing for funeral services in advance when it stipulates the use of cremation.
IV.-The crematorium operator displays information in the public area of the establishment concerning the destination of metals resulting from cremation and the use of any proceeds from their disposal. This information includes:
1° The provisions of I and II of article L. 2223-18-1-1;
2° The list of municipalities benefiting from the payments mentioned in I of this article and the list of associations of general interest and foundations recognised as being of public utility drawn up on the basis of II of this article.
V.-The crematorium operator shall publish each year the amounts and beneficiaries of any funding and donations made pursuant to Article L. 2223-18-1-1.
The manager makes a paper copy of this publication available free of charge in the public area of the establishment. This publication is also made available, in electronic form, on the manager’s website where it exists.
When the crematorium is subject to delegated management, this publication is sent to the delegating authority.
