Article R2223-18 of the French General Code of Local Authorities

After the expiry of the one-year period provided for in Article L. 2223-17, where the plot is still in a state of abandonment, a new official report, drawn up by the mayor or his delegate, in the forms provided for by the articles R. 2223-13 and R. 2223-14, is notified to the interested parties with an indication of the action that must be taken.

One month after this notification and in accordance with article L. 2223-17, the mayor may refer the matter to the municipal council, which is called upon to decide whether or not to take over the plot. If so, the mayor may issue the decree provided for in the third paragraph of article L. 2223-17.

Après l’expiration du délai d’un an prévu à l’article L. 2223-17, lorsque la concession est toujours en état d’abandon, un nouveau procès-verbal, dressé par le maire ou son délégué, dans les formes prévues par les articles R. 2223-13 et R. 2223-14, est notifié aux intéressés avec indication de la mesure qui doit être prise.

Un mois après cette notification et conformément à l’article L. 2223-17, le maire a la faculté de saisir le conseil municipal qui est appelé à décider si la reprise de la concession est prononcée ou non. Dans l’affirmative, le maire peut prendre l’arrêté prévu au troisième alinéa de l’article L. 2223-17.
