Article R2223-6 of the French General Code of Local Authorities

Where the cemetery does not offer sufficient space for the construction of the ossuary referred to in the first paragraph of article L. 2223-4, the remains may be transferred by decision of the mayor to the ossuary of another cemetery belonging to the municipality.

Where the commune is a member of a syndicate of communes, a district or an urban community, the transfer may take place under the same conditions on the territory of another commune belonging to the same grouping of communes.

The ashes of exhumed remains are deposited in a columbarium, in the ossuary or scattered in the place specially designated for this purpose provided for in article R. 2223-9.

The names of persons, even if no remains have been found, are recorded in a register available to the public and may be engraved on a device made of durable materials in the place specially designated for this purpose or above the ossuary.

Lorsque le cimetière n’offre pas d’emplacement suffisant pour la construction de l’ossuaire visé au premier alinéa de l’article L. 2223-4, les restes peuvent être transférés par décision du maire dans l’ossuaire d’un autre cimetière appartenant à la commune.

Lorsque la commune est membre d’un syndicat de communes, d’un district ou d’une communauté urbaine, le transfert peut avoir lieu dans les mêmes conditions sur le territoire d’une autre commune appartenant au même groupement de communes.

Les cendres des restes exhumés sont déposées dans un columbarium, dans l’ossuaire ou dispersées dans le lieu spécialement affecté à cet effet prévu à l’article R. 2223-9.

Les noms des personnes, même si aucun reste n’a été retrouvé, sont consignés dans un registre tenu à la disposition du public et peuvent être gravés sur un dispositif établi en matériaux durables dans le lieu spécialement affecté à cet effet ou au-dessus de l’ossuaire.
