Article R2223-95 of the French General Code of Local Authorities

When the transfer of the body to the mortuary room requires leaving the grounds of a health establishment or an accommodation establishment for the elderly or one of their sites, the transport without coffining is carried out with the agreement of the head of the establishment, under the conditions provided for in 2° and 3° of article R. 2213-8-1 and in article R. 2213-9.

When the transfer referred to in the previous paragraph is to a mortuary located on the territory of another municipality, the mayor of that municipality shall receive a copy of this agreement without delay.

When the health establishment where the death occurred is not the manager of the receiving mortuary, the person in charge of the mortuary receives a copy of this agreement.

Lorsque le transfert du corps en chambre mortuaire nécessite de sortir de l’enceinte d’un établissement de santé ou d’un établissement d’hébergement pour personnes âgées ou de l’un de leurs sites d’implantation, le transport sans mise en bière s’effectue après accord du chef d’établissement, dans les conditions prévues aux 2° et 3° de l’article R. 2213-8-1 et à l’article R. 2213-9.

Lorsque le transfert visé à l’alinéa précédent s’effectue vers une chambre mortuaire située sur le territoire d’une autre commune, le maire de celle-ci reçoit sans délai copie de cet accord.

Lorsque l’établissement de santé où le décès a eu lieu n’est pas le gestionnaire de la chambre mortuaire d’accueil, le responsable de celle-ci reçoit copie de cet accord.
