Article R2333-114-1 of the French General Code of Local Authorities

The fee payable each year to a municipality, a public establishment for inter-municipal cooperation or a mixed syndicate for the temporary occupation of its public domain by work sites on gas transmission network structures and public gas distribution networks, as well as on individual gas pipelines, is set by the municipal council, the community council or the syndicate committee within the following ceiling:

PR’= 0.70* L

Where:

PR’, expressed in euros, is the ceiling for the fee payable, in respect of the temporary occupation of the public domain by worksites, by the occupier of the domain;

L represents the length, expressed in metres, of the pipes built or renewed on the public domain and brought into gas service during the year preceding that in respect of which the fee is payable.

To enable the municipality, the public establishment for inter-municipal cooperation or the mixed syndicate to set this fee, the occupier of the land communicates the total length of the pipes built and renewed on their public land and put into gas during the year preceding the year for which the fee is due.

La redevance due chaque année à une commune, un établissement public de coopération intercommunale ou un syndicat mixte pour l’occupation provisoire de son domaine public par les chantiers de travaux sur des ouvrages des réseaux de transport de gaz et des réseaux publics de distribution de gaz, ainsi que sur des canalisations particulières de gaz, est fixée par le conseil municipal, le conseil communautaire ou le comité syndical dans la limite du plafond suivant :

Où :

PR’, exprimé en euros, est le plafond de redevance due, au titre de l’occupation provisoire du domaine public par les chantiers de travaux, par l’occupant du domaine ;

L représente la longueur, exprimée en mètres, des canalisations construites ou renouvelées sur le domaine public et mises en gaz au cours de l’année précédant celle au titre de laquelle la redevance est due.

Pour permettre à la commune, l’établissement public de coopération intercommunale ou le syndicat mixte de fixer cette redevance, l’occupant du domaine communique la longueur totale des canalisations construites et renouvelées sur leur domaine public et mises en gaz au cours de l’année précédant celle au titre de laquelle la redevance est due.
