Article R2333-120-32 bis of the French General Code of Local Authorities

Electronic communication with the Commission du contentieux du stationnement payant (Pay Parking Litigation Commission) may take place, under conditions set by joint order of the Minister of Justice and the Minister of the Interior:

1° Either by means of a portal accessible via the Internet to the applicant, the municipality, the public establishment for inter-municipal cooperation, the competent mixed syndicate, or their agents;

or
2° Or by means of a teletransmission system offered to the municipality, the public establishment for inter-municipal cooperation, or the competent mixed syndicate, in its capacity as defendant, or to their agents;

These systems guarantee the reliability of the information provided.
These systems guarantee the reliable identification of the parties or their representatives, the integrity of the documents sent and the security and confidentiality of exchanges. They make it possible to establish with certainty the date and time when a document was made available and when it was first consulted by its recipient.

The order referred to in the first paragraph defines the conditions for the use of the system.

It also defines the procedures for registering on the portal for the persons mentioned in 1° and 2° of this article and the procedures for approval and agreement for the teletransmission system.

Article R2333-120-32 bis

La communication électronique avec la commission du contentieux du stationnement payant peut se faire, dans des conditions fixées par arrêté conjoint du garde des sceaux, ministre de la justice et du ministre de l’intérieur :

1° Soit au moyen d’un portail accessible par internet au requérant, à la commune, à l’établissement public de coopération intercommunale, au syndicat mixte compétent, ou à leurs mandataires ;

2° Soit au moyen d’un dispositif de télétransmission proposé à la commune, à l’établissement public de coopération intercommunale, ou au syndicat mixte compétent, en qualité de défendeur, ou à leurs mandataires.

Ces dispositifs garantissent la fiabilité de l’identification des parties ou de leurs mandataires, l’intégrité des documents adressés ainsi que la sécurité et la confidentialité des échanges. Ils permettent d’établir de manière certaine la date et l’heure de la mise à disposition d’un document ainsi que celles de sa première consultation par son destinataire.

L’arrêté mentionné au premier alinéa définit les caractéristiques et les exigences techniques qui doivent être respectées par les utilisateurs des dispositifs de communication électronique. Il définit également les modalités d’inscription au portail des personnes mentionnées au 1° et au 2° du présent article et les modalités d’homologation et de conventionnement pour le dispositif de télétransmission.
