Subsection 8: The Pay Parking Disputes Commission

The magistrates of the administrative courts and administrative courts of appeal who are members of the commission are appointed by order of the Vice-President of the Council of State. The judicial magistrates who are members of the commission are appointed by order of the Keeper of the Seals. The magistrates other than serving magistrates assigned to the commission are appointed for a renewable period of three years.

The magistrates mentioned in the last paragraph of article R. 2333-120-21 fees, the unit amount of which, as well as the maximum number that may be paid annually by the same rapporteur, are set by joint order of the Minister of Justice and the Minister for the Budget.

The commission comprises two chambers. The creation of additional chambers may be decided by the vice-president of the Council of State, on the proposal of the president of the commission. The chamber presidents are appointed by the vice-president of the Council of State from among the magistrates of the administrative courts and administrative courts of appeal.

The Chairman of the Commission or the magistrate he appoints for this purpose makes the decision alone. He may decide to refer the case to a panel.

Where the Commission rules as a panel, pursuant to Article L. 2333-87-4, the case shall be heard either by a chamber sitting as a panel or by the Commission sitting as a full Commission.

In the absence or impediment of the chairman of the chamber, it shall be chaired by a magistrate appointed for this purpose by the chairman of the commission. It shall be composed of three members. It shall be composed of three members. It comprises three members.

The committee sits in plenary session under the chairmanship of its president or, in the event of absence or impediment, by the president of the chamber with the most seniority in office.
