Article R2333-120-63 of the French General Code of Local Authorities

The decision to refer a matter pursuant to Article L. 2333-87-9 is taken by the committee acting as a collegial body. It is sent by the committee clerk’s office to the secretariat of the Administrative Jurisdiction Division of the Conseil d’Etat, along with the case file, within eight days of its pronouncement. The parties are notified of this transmission by notification of the decision to them, by any means allowing proof of its receipt by the addressees.

The provisions of the articles R. 113-2 to R. 113-4 of the Code of Administrative Justice are applicable to referrals made pursuant to this article.

La décision prononçant le renvoi d’une question en application de l’article L. 2333-87-9 est prise par la commission statuant en formation collégiale. Elle est adressée par le greffe de la commission au secrétariat de la section du contentieux du Conseil d’Etat, avec le dossier de l’affaire, dans les huit jours de son prononcé. Les parties sont avisées de cette transmission par notification qui leur est faite de la décision, par tout moyen permettant de faire la preuve de sa réception par les destinataires.

Les dispositions des articles R. 113-2 à R. 113-4 du code de justice administrative sont applicables aux renvois prononcés en application du présent article.
