Article R2333-120-31 of the French General Code of Local Authorities

I. – In the event of a challenge to the decision made following the mandatory prior administrative appeal, the request must be accompanied by:

1° A copy of the payment notice for the post-parking charge;

2° A copy of the compulsory prior administrative appeal lodged with the commune, the public establishment for inter-communal cooperation, the mixed syndicate or the third-party contractor to which the sworn agent who drew up the payment notice is answerable;

3° A copy of the postal or electronic acknowledgement of receipt of the compulsory prior administrative appeal;

4° Where applicable, a copy of the decision issued following the compulsory prior administrative appeal;

5° The document justifying the prior payment of the amount of the post-parking charge or the rectifying payment notice.

II. – If the enforcement order provided for in article L. 2333-87 is contested, the request must be accompanied by.

1° A copy of the warning sent pursuant to article L. 2323-7-1 of the General Code on the Ownership of Public Persons or, failing this, an extract from the writ of execution provided for by article L. 2333-87 of this code;

2° A document proving prior payment of the amount of the post-parking charge or the rectifying payment notice and the surcharge provided for in IV of article L. 2333-87.

I. – En cas de contestation de la décision rendue à l’issue du recours administratif préalable obligatoire, la requête doit être accompagnée :

1° De la copie de l’avis de paiement du forfait de poststationnement ;

2° De la copie du recours administratif préalable obligatoire formé auprès de la commune, de l’établissement public de coopération intercommunale, du syndicat mixte ou du tiers contractant dont relève l’agent assermenté ayant établi l’avis de paiement ;

3° De la copie de l’accusé de réception postale ou électronique du recours administratif préalable obligatoire ;

4° Le cas échéant, de la copie de la décision rendue à l’issue du recours administratif préalable obligatoire ;

5° De la pièce justifiant du paiement préalable du montant du forfait de poststationnement ou de l’avis de paiement rectificatif.

II. – En cas de contestation du titre exécutoire prévu par l’article L. 2333-87, la requête doit être accompagnée.

1° De la copie de l’avertissement adressé en application de l’article L. 2323-7-1 du code général de la propriété des personnes publiques ou, à défaut, d’un extrait du titre exécutoire prévu par l’article L. 2333-87 du présent code ;

2° De la pièce justifiant du paiement préalable du montant du forfait de poststationnement ou de l’avis de paiement rectificatif et de la majoration prévue au IV de l’article L. 2333-87.
