Article R2333-120-44 of the French General Code of Local Authorities

The commune, the public establishment for inter-communal cooperation or the competent mixed syndicate has a period of one month from the date on which the application is communicated to it to produce a statement of defence. This communication constitutes formal notice.

Failing production, the investigation is closed and the defendant is deemed to have acquiesced in the facts set out in the applicant’s request.

La commune, l’établissement public de coopération intercommunale ou le syndicat mixte compétent dispose d’un délai d’un mois à compter de la date à laquelle lui est communiquée la requête pour produire un mémoire en défense. Cette communication vaut mise en demeure.

A défaut de production, l’instruction est close et le défendeur est réputé avoir acquiescé aux faits exposés dans la requête du requérant.
