Article R250-5 of the French Insurance Code

Decisions of the Central Pricing Board are taken by a majority of the members present. In the event of a tie, the chairman has the casting vote. For each of the formations mentioned in 1° to 5° of Article R. 250-1, regardless of the number of members appointed, the Central Rates Office may only deliberate regularly if it includes, in addition to its chairman, at least one representative of the insurers and one representative of the taxable persons.

When the insurance undertaking from which the underwriting of a contract has been requested is represented by a member of the Central Rates Office, the latter shall withdraw. By way of derogation from the first paragraph of this article, if this deferral results in the Chairman deliberating with only one member, the decision is in order.

The decision taken by the Central Rates Office is notified to the insured and the insurer within ten days.

Les décisions du Bureau central de tarification sont prises à la majorité des membres présents. En cas de partage, la voix du président est prépondérante. Pour chacune des formations mentionnées au 1° à 5° de l’article R. 250-1, quel que soit le nombre de membres nommés, le Bureau central de tarification ne peut régulièrement délibérer que s’il comprend, outre son président, au moins un représentant des assureurs et un représentant des assujettis.

Lorsque l’entreprise d’assurance auprès de laquelle la souscription d’un contrat a été sollicitée est représentée par un membre du Bureau central de tarification, ce dernier se déporte. Par dérogation au premier alinéa du présent article, si ce déport conduit le président à délibérer avec un seul membre, la décision est régulière.

La décision prise par le Bureau central de tarification est notifiée à l’assuré et à l’assureur dans un délai de dix jours.
