Article R311-16 of the French Insurance Code

Where the assets and liabilities of several persons subject to resolution proceedings have been transferred to the same bridge institution, the winding-up proceedings referred to in Chapter VI of Title II of Book III shall apply separately to the assets and liabilities of each of these persons and not to the bridge institution itself.

The assets concerned are identified individually in the accounts of the bridge facility. They are subject to separate liquidation without creditors in respect of one of the transferred assets being able to take advantage of the assets held by the bridge institution and resulting from the transfer of the assets of another person.

Lorsque les patrimoines de plusieurs personnes soumises à une procédure de résolution ont été transférés au même établissement-relais, la procédure de liquidation mentionnée au chapitre VI du titre II du livre III s’applique séparément au patrimoine de chacune de ces personnes et non à l’établissement-relais lui-même.

Les patrimoines concernés sont individualisés dans la comptabilité de l’établissement-relais. Ils font l’objet d’une liquidation séparée sans que les créanciers au titre de l’un des patrimoines transférés puissent se prévaloir des actifs détenus par l’établissement-relais et qui sont issus du transfert du patrimoine d’une autre personne.
