Article R312-13 of the French Sports Code

Within four months of receiving the application for approval, the Prefect, after obtaining the opinion of the Departmental Advisory Committee on Safety and Accessibility and, in the cases provided for by the order referred to in article R. 312-11, of the National Committee on Safety for Sports Venues, notifies the owner of the facility of his opinion on the application for approval in accordance with the order referred to in article R. 312-9.

The Prefect’s opinion may be made subject to the completion of work intended to bring the sports arena into compliance with the safety rules resulting from the Building and Housing Code. In this case, authorisation to open the stadium will only be granted once the Prefect has lifted the reservations after consulting the relevant committee.

Article R312-13

Dans un délai de quatre mois après la réception de la demande d’homologation, le préfet, après avis de la commission consultative départementale de sécurité et d’accessibilité et, dans les cas prévus par l’arrêté mentionné à l’article R. 312-11, de la Commission nationale de sécurité des enceintes sportives, notifie au propriétaire de l’équipement son avis sur le dossier de demande d’homologation conforme à l’arrêté mentionné à l’article R. 312-9.

L’avis du préfet peut être subordonné à l’accomplissement de travaux destinés à mettre l’enceinte sportive en conformité avec les règles de sécurité résultant du code de la construction et de l’habitation. L’autorisation d’ouverture n’est alors accordée qu’après levée des réserves par le préfet après avis de la commission compétente.
