Article R3124-1 of the French Public procurement code

When the conceding authority makes use of the possibility to negotiate provided for in article L. 3121-1, it may decide to limit the number of tenderers admitted to take part in the negotiation.
It selects the tenderer or tenderers by applying the award criteria set out in articles R. 3124-4 and R. 3124-5.

Article R3124-1

Lorsque l’autorité concédante fait usage de la possibilité de négocier prévue à l’article L. 3121-1, elle peut décider de limiter le nombre de soumissionnaires admis à participer à la négociation.
Elle procède à la sélection du ou des soumissionnaires en appliquant les critères d’attribution fixés aux articles R. 3124-4 et R. 3124-5.
