Article R322-113 of the French Insurance Code

Insurance policies issued by mutual insurance companies reinsured with a union must contain, in clearly visible characters, the name and address of the union and reproduce the clause in the reinsurance treaty by which the union declares that it will in all cases jointly and severally guarantee the commitments of the mutual insurance company.

The general terms and conditions of these policies must be submitted by the association to the Minister for the Economy and Finance under the conditions set out in Article L. 310-8. They must specify that if the union’s authorisation is withdrawn, the policy will be terminated on the tenth day at noon from the date of publication in the Journal officiel of the decision withdrawing authorisation, in which case the portion of the premium relating to the period not covered will be returned to the insured.

Les polices d’assurance délivrées par les sociétés d’assurance mutuelles réassurées auprès d’une union doivent contenir en caractères très apparents la désignation et l’adresse de cette union et reproduire la clause du traité de réassurance par laquelle l’union déclare se porter dans tous les cas caution solidaire des engagements de la société d’assurance mutuelle.

Les conditions générales de ces polices doivent être soumises par l’union au ministre de l’économie et des finances dans les conditions prévues par l’article L. 310-8. Elles doivent préciser que si l’agrément accordé à l’union lui est retiré, la police sera résiliée le dixième jour à midi à compter de la date de la publication au Journal officiel de la décision prononçant le retrait d’agrément, la portion de cotisation afférente à la période non garantie étant alors restituée à l’assuré.
