Article R*322-148 of the French Insurance Code

For a single tontine company, there must be a single association in the event of death. However, a second “counter-insurance” association, which must be separate from the first, may be set up for the sole purpose of offsetting the loss that may result from the death of members for subscribers to survival associations set up by the company.

Pour une même société à forme tontinière, l’association en cas de décès doit être unique. Toutefois, une seconde association dite de contre-assurance, obligatoirement distincte de la première, peut être constituée dans le but exclusif de compenser la perte pouvant résulter du décès des sociétaires pour les souscripteurs aux associations en cas de survie formées par la société.
