As soon as an application for authorisation is received, the Prefect will refer the matter to the local police authorities for their opinion.
Except in the case provided for in the fourth paragraph, the authorisation is issued by the Prefect after consulting the departmental road safety committee. The latter may recommend additional requirements to those laid down by the organisers. The Prefect may also prescribe additional measures in the interests of traffic, public safety or tranquillity, and the environment. For events taking place on land or courses, the Prefect will attach to his authorisation order detailed plans of the areas reserved for spectators as set out in article R. 331-21. All non-reserved areas are off-limits to spectators.
If the event takes place on land or courses permanently closed to public traffic and not subject to the procedure provided for in article L. 421-2 of the town planning code, the prefect may also consult the government departments responsible for environmental matters and any person or advisory body whose assistance he deems useful. The authorisation issued for these events constitutes authorisation under the second paragraph of article L. 362-3 of the Environment Code.
If the event takes place in twenty or more départements, the authorisation is issued by the Minister of the Interior on the advice of the prefect of each département crossed, after the latter has consulted the département road safety commission. The departmental commissions may recommend and the Minister may prescribe additional measures under the conditions set out in the second paragraph. The Minister shall attach to his authorisation order the detailed plans provided for in the second paragraph.
The authorisation decision is published and notified to the applicant.
