1° The technical provisions of insurance undertakings referred to in Article L. 310-3-2 operating both on French and Monegasque territory must be represented under the conditions laid down by French regulations; however, the assets accepted to represent said provisions may include up to 5% of the amount thereof in Monegasque movable or immovable property investments, subject to authorisation given jointly, for each undertaking or for each case, by the Autorité de contrôle prudentiel et de résolution of the French Republic and by the Minister of State of the Principality of Monaco;
2° For operations carried out in the French overseas departments and territories and in Mayotte, the Autorité de contrôle prudentiel et de résolution may, on the recommendation of the representative of the State in the local authority concerned, grant exemptions from the rules set out in Article R. 332-3. It may also, on an exceptional basis, grant undertakings exemptions from the supervisory regulations;
3° The limit provided for in 2° of Article R. 332-3 for real estate assets is reduced to 10% for the representation of technical provisions relating to tontines, unless an exemption is granted by the Autorité de contrôle prudentiel et de résolution; this same limit does not apply to the representation of technical provisions relating to the acquisition of real estate through the payment of life annuities.
