Article R356-33 of the French Insurance Code

The participating and parent undertakings referred to respectively in the second and third paragraphs of article L. 356-2 shall review the written policies referred to in the third paragraph of article L. 356-18 at least once a year. These policies are subject to the prior approval of the Board of Directors or the Supervisory Board as the case may be. They are adapted to take account of any significant change affecting the system or the area concerned.

For each of the attributions of the administrative, management and supervisory body provided for in Commission Delegated Regulation (EU) No 2015/35 of 10 October 2014, the written policies shall specify whether it is the responsibility of the board of directors or the chief executive officer or, as the case may be, the supervisory board or the management board of the participating and parent undertakings referred to in the second and third paragraphs of Article L. 356-2 respectively, without prejudice to the other provisions of this Title.

Les entreprises participantes et mères mentionnées respectivement aux deuxième et troisième alinéas de l’article L. 356-2 réexaminent les politiques écrites mentionnées au troisième alinéa de l’article L. 356-18 au moins une fois par an. Ces politiques sont soumises à l’approbation préalable du conseil d’administration ou du conseil de surveillance selon les cas. Elles sont adaptées pour tenir compte de tout changement important affectant le système ou le domaine concerné.

Pour chacune des attributions de l’organe d’administration, de gestion et de contrôle prévues par le règlement délégué (UE) n° 2015/35 de la Commission du 10 octobre 2014, les politiques écrites précisent si elle incombe au conseil d’administration ou au directeur général ou, le cas échéant, au conseil de surveillance ou au directoire des entreprises participantes et mères mentionnées respectivement aux deuxième et troisième alinéas de l’article L. 356-2, sans préjudice des autres dispositions du présent titre.
