Article R412-21 of the French Consumer Code

The enforcement measures provided for in Article L. 412-1 :

1° The provisions of Articles 1 to 7,9 to 18,21,22,29,36,38,45 and 48 of Regulation (EU) 2019/787 of the European Parliament and of the Council of 17 April 2019 on the definition, description, presentation and labelling of spirit drinks, the use of the names of spirit drinks in the presentation and labelling of other foodstuffs, the protection of geographical indications relating to spirit drinks, and the use of ethyl alcohol and distillates of agricultural origin in alcoholic beverages ;

2° The provisions of Articles 1, 2,8 to 11,15,18,28 to 35,38,47 and 48 of Commission Delegated Regulation (EU) 2018/273 of 11 December 2017 supplementing Regulation (EU) No 1308/2013 of the European Parliament and of the Council as regards the vineyard planting authorisation scheme, the vineyard register, accompanying documents and certification, the entry/exit register, compulsory declarations, notifications and publication of notified information ;

3° The provisions of Articles 1, 13 to 25 and 35 of Commission Implementing Regulation (EU) 2018/274 of 11 December 2017 laying down detailed rules for the application of Regulation (EU) No 1308/2013 of the European Parliament and of the Council as regards the vineyard planting authorisation scheme, certification, the entry and exit register, compulsory declarations and notifications, and of Regulation (EU) No 1306/2013 of the European Parliament and of the Council as regards related controls;

4° a) The provisions of Articles 1, 40 to 58 and Annexes I to VII of Commission Delegated Regulation (EU) 2019/33 of 17 October 2018 supplementing Regulation (EU) No 1308/2013 of the European Parliament and of the Council as regards applications for the protection of designations of origin, geographical indications and traditional expressions in the wine sector, the objection procedure, restrictions on use, amendments to the product specification, cancellation of protection, labelling and presentation ;

b) The provisions of Article 14 of Commission Implementing Regulation (EU) 2019/34 of 17 October 2018 laying down detailed rules for the implementation of Regulation (EU) No 1308/2013 of the European Parliament and of the Council as regards applications for the protection of designations of origin, geographical indications and traditional expressions in the wine sector, the objection procedure, amendments to the product specification, the register of protected names, the cancellation of protection and the use of symbols, and Regulation (EU) No 1306/2013 of the European Parliament and of the Council as regards an appropriate control system ;

5° The provisions of Articles 1 to 14 and Annexes I to III of Commission Delegated Regulation (EU) 2019/934 of 12 March 2019 supplementing Regulation (EU) No 1308/2013 of the European Parliament and of the Council as regards wine-growing zones where the alcoholic strength may be increased, authorised oenological practices and restrictions applicable to the production and conservation of vine products, the minimum percentage of alcohol for by-products and their disposal, and the publication of OIV sheets ;

6° The provisions of Articles 78,80,81,82,90,92,93,103,112,113,117 to 121,147,223 and Annexes VII and VIII of Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013, as amended, on the common organisation of the markets in agricultural products for the products defined in Part XII of Annex I to that Regulation;

7° The provisions of Articles 1 to 8 and Article 20 of Regulation (EU) No 251/2014 of the European Parliament and of the Council of 26 February 2014 on the definition, description, presentation, labelling and the protection of geographical indications of aromatized wine products and its annexes.

Article R412-21

Constituent les mesures d’exécution prévues à l’article L. 412-1 :

1° Les dispositions des articles 1er à 7,9 à 18,21,22,29,36,38,45 et 48 du règlement (UE) 2019/787 du Parlement européen et du Conseil du 17 avril 2019 concernant la définition, la désignation, la présentation et l’étiquetage des boissons spiritueuses, l’utilisation des noms de boissons spiritueuses dans la présentation et l’étiquetage d’autres denrées alimentaires, la protection des indications géographiques relatives aux boissons spiritueuses, ainsi que l’utilisation de l’alcool éthylique et des distillats d’origine agricole dans les boissons alcoolisées ;

2° Les dispositions des articles 1er, 2,8 à 11,15,18,28 à 35,38,47 et 48 du règlement délégué (UE) 2018/273 de la Commission du 11 décembre 2017 complétant le règlement (UE) n° 1308/2013 du Parlement européen et du Conseil en ce qui concerne le régime d’autorisations de plantations de vigne, le casier viticole, les documents d’accompagnement et la certification, le registre des entrées et des sorties, les déclarations obligatoires, les notifications et la publication des informations notifiées ;

3° Les dispositions des articles 1er, 13 à 25 et 35 du règlement d’exécution (UE) 2018/274 de la Commission du 11 décembre 2017 portant modalités d’application du règlement (UE) n° 1308/2013 du Parlement européen et du Conseil en ce qui concerne le régime d’autorisations de plantations de vigne, la certification, le registre des entrées et des sorties, les déclarations et les notifications obligatoires, et du règlement (UE) n° 1306/2013 du Parlement européen et du Conseil en ce qui concerne les contrôles y relatifs ;

4° a) Les dispositions des articles 1er, 40 à 58 et des annexes I à VII du règlement délégué (UE) 2019/33 de la Commission du 17 octobre 2018 complétant le règlement (UE) n° 1308/2013 du Parlement européen et du Conseil en ce qui concerne les demandes de protection des appellations d’origine, des indications géographiques et des mentions traditionnelles dans le secteur vitivinicole, la procédure d’opposition, les restrictions d’utilisation, les modifications du cahier des charges, l’annulation de la protection, l’étiquetage et la présentation ;

b) Les dispositions de l’article 14 du règlement d’exécution (UE) 2019/34 de la Commission du 17 octobre 2018 portant modalités d’application du règlement (UE) n° 1308/2013 du Parlement européen et du Conseil en ce qui concerne les demandes de protection des appellations d’origine, des indications géographiques et des mentions traditionnelles dans le secteur vitivinicole, la procédure d’opposition, les modifications du cahier des charges, le registre des dénominations protégées, l’annulation de la protection et l’utilisation des symboles, et du règlement (UE) n° 1306/2013 du Parlement européen et du Conseil en ce qui concerne un système de contrôle approprié ;

5° Les dispositions des articles 1er à 14 et des annexes I à III du règlement délégué (UE) 2019/934 de la Commission du 12 mars 2019 complétant le règlement (UE) n° 1308/2013 du Parlement européen et du Conseil en ce qui concerne les zones viticoles où le titre alcoométrique peut être augmenté, les pratiques œnologiques autorisées et les restrictions applicables à la production et à la conservation de produits de la vigne, le pourcentage minimal d’alcool pour les sous-produits et leur élimination, et la publication des fiches de l’OIV ;

6° Les dispositions des articles 78,80,81,82,90,92,93,103,112,113,117 à 121,147,223 et des annexes VII et VIII du règlement (UE) n° 1308/2013 du Parlement européen et du Conseil du 17 décembre 2013 modifié portant organisation commune des marchés des produits agricoles pour les produits définis à la partie XII de l’annexe I de ce règlement ;

7° Les dispositions des articles 1 à 8 et de l’article 20 du règlement (UE) n° 251/2014 du Parlement européen et du Conseil du 26 février 2014 concernant la définition, la description, la présentation, l’étiquetage et la protection des indications géographiques des produits vinicoles aromatisés et ses annexes.
