Article R421-1 of the French Insurance Code

The guarantee fund shall cover, in accordance with the provisions of this section, compensation due to victims of accidents referred to in article L. 421-1 or to their dependants provided that these accidents occurred in mainland France, Mayotte or the overseas departments.

The Guarantee Fund will not pay compensation due to victims of accidents involving land motor vehicles or the trailers or semi-trailers of such vehicles normally based in the territory of a State other than France, as referred to in Article L. 211-4, when the French Central Bureau is responsible for compensating these victims in whole or in part.

The French central bureau is the national insurance bureau set up in France under the conditions mentioned in the second paragraph of article R. 211-22.

The provisions of articles R. 421-5 to R. 421-9 are applicable to refusals to accept responsibility by the French central bureau.

Article R421-1

Sont prises en charge par le fonds de garantie, conformément aux dispositions de la présente section, les indemnités dues aux victimes d’accidents mentionnés à l’article L. 421-1 ou à leurs ayants droit à la condition que ces accidents soient survenus en France métropolitaine, à Mayotte ou dans les départements d’outre-mer.

Ne sont pas prises en charge par le fonds de garantie les indemnités dues aux victimes d’accidents dans lesquels sont impliqués des véhicules terrestres à moteur ainsi que les remorques ou semi-remorques de ces véhicules ayant leur stationnement habituel sur le territoire d’un Etat, autre que la France, visé à l’article L. 211-4, lorsque l’indemnisation de ces victimes incombe au bureau central français pour leur totalité ou en partie.

Le bureau central français est le bureau national d’assurance constitué en France dans les conditions mentionnées au deuxième alinéa de l’article R. 211-22.

Les dispositions des articles R. 421-5 à R. 421-9 sont applicables aux refus de prise en charge opposés par le bureau central français.
