If the perpetrator of a personal injury accident is unknown, the official report or the report drawn up or established by law enforcement officers and relating to this accident must expressly mention this circumstance.
If the perpetrator is known, the same document must indicate whether the perpetrator is insured against accidents. If so, it must specify the name and address of the insurance company and the policy number.
Any wilful omission of a declaration or false declaration made in bad faith will be punishable by the fine laid down for third-class offences.
If one or more of the items of information referred to in the second paragraph have not been provided by the person responsible for the accident at the time the report is drawn up, this fact shall be mentioned, together with the undertaking given by the said person to provide this information within a week. In this case, a supplementary report will be drawn up at a later date.
A copy of any record or report relating to a personal accident caused by an unknown or uninsured perpetrator is sent to the guarantee fund within ten days of its date by the police or gendarmerie authorities.
