Article R421-7 of the French Insurance Code

Where, in the circumstances referred to in article R. 421-6, a claim for compensation is brought before a court other than a criminal court, the injured party or those entitled on his behalf must, in the event of an action against either the insurer or the liable party, implead the liable party or the insurer, as the case may be.

Lorsque, dans l’hypothèse prévue à l’article R. 421-6, la demande d’indemnité est portée devant une juridiction autre qu’une juridiction répressive, la victime ou ses ayants droit doivent, en cas d’action dirigée soit contre l’assureur, soit contre le responsable, mettre en cause, suivant le cas, le responsable ou l’assureur.
