Article R421-71 of the French Insurance Code

When a claim is referred to it in its capacity as a compensation body within the meaning of Article L. 424-1, the Fonds de garantie des assurances obligatoires de dommages shall immediately inform :

a) The insurance undertaking of the vehicle whose use caused the accident or its claims representative ;

b) The compensation body in the Member State of establishment of the insurance undertaking which took out the contract;

c) If identified, the person who caused the accident, that he has received a claim from the injured party and that he will respond to it within two months of the submission of the claim.

Article R421-71

Lorsqu’il est saisi en qualité d’organisme d’indemnisation au sens de l’article L. 424-1, le fonds de garantie des assurances obligatoires de dommages informe immédiatement :

a) L’entreprise d’assurance du véhicule dont la circulation a causé l’accident ou son représentant chargé du règlement des sinistres ;

b) L’organisme d’indemnisation de l’Etat membre d’établissement de l’entreprise d’assurance qui a souscrit le contrat ;

c) Si elle est identifiée, la personne ayant causé l’accident, du fait qu’il a reçu une demande d’indemnisation de la part de la personne lésée et qu’il va y répondre, dans un délai de deux mois à compter de la présentation de cette demande.
