Article R442-10-9 of the French Insurance Code

The guarantee is subject to the following conditions:

1° It may only be granted on presentation of the financing plan for the acquisition of a civil vessel or spacecraft, for which the company mentioned in Article R. 442-10-8 certifies that it has received a foreign offer benefiting from public export support;

2° It may not cover more than 80% of the amounts owed to the beneficiaries of the guarantee or, where the beneficiary of the guarantee is a French supplier, 80% of the loss suffered on the sums that it proves to have paid for the performance of its contract;

3° Its duration may not exceed that of the financial commitments granted by the undertaking referred to in Article R. 442-10-8 to the beneficiaries of the guarantee;

4° It is granted at a remuneration in line with market prices, taking into account the financial health of the undertaking referred to in article R. 442-10-8, the collateral offered and the duration of the guarantee.

Article R442-10-9

La garantie est soumise aux conditions suivantes :

1° Elle ne peut être accordée que sur présentation du plan de financement de l’acquisition d’un navire ou engin spatial civil, pour laquelle l’entreprise mentionnée à l’article R. 442-10-8 certifie avoir reçu une offre étrangère bénéficiant d’un soutien public à l’exportation ;

2° Elle ne peut pas couvrir plus de 80 % des montants dus aux bénéficiaires de la garantie ou, lorsque le bénéficiaire de la garantie est un fournisseur français, 80 % de la perte subie sur les sommes qu’il justifie avoir payées pour l’exécution de son contrat ;

3° Sa durée ne peut dépasser celle des engagements financiers consentis par l’entreprise mentionnée à l’article R. 442-10-8 aux bénéficiaires de la garantie ;

4° Son octroi donne lieu à une rémunération conforme aux prix de marché compte tenu de la santé financière de l’entreprise mentionnée à l’article R. 442-10-8, des sûretés offertes et de la durée de la garantie.
