Article R4741-2 of the French Labour Code

An employer who is aware of an accident at work resulting in the death of a worker and who fails to inform the Labour Inspectorate, in accordance with the procedures set out in article R. 4121-5, is liable to a fifth-class fine.

Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the French Criminal Code.

Le fait pour l’employeur ayant connaissance d’un accident du travail ayant entraîné le décès d’un travailleur de ne pas en informer l’inspection du travail, selon les modalités prévues par l’article R. 4121-5, est puni de l’amende prévue pour les contraventions de la cinquième classe.


La récidive est réprimée conformément aux articles 132-11 et 132-15 du code pénal.
