Article R512-5 of the French Insurance Code

I.-Registration and enrolment are carried out within a maximum of two months from the date of receipt by the organisation of a complete file. The organisation will send the applicant a certificate showing the registration number and the date of registration.

II – If the examination of the complete file shows that the application for registration does not comply with the provisions of this Code, the body will take a decision not to register and will notify the applicant by registered letter with acknowledgement of receipt within the period specified in the first sentence of I of this article.

III – Registration must be renewed annually in accordance with the procedures laid down by order of the Minister for the Economy.

IV – Intermediaries and ancillary intermediaries shall inform the CMF of any change in the information concerning them and of any event that may have an impact on their registration, such as a change in their place of business, cessation of activity or deletion from the Register of Companies. The information is sent in the month preceding the event, or if the event cannot be anticipated, in the month that follows.

V.-The person who has issued a mandate to one of the intermediaries or intermediaries on an ancillary basis falling into the categories mentioned in 2°, 3° or 4° of I of article R. 511-2 shall notify the body of the mandate thus issued as soon as it takes effect, as well as of the cessation of the function of this intermediary or intermediary on an ancillary basis in the month preceding the end of the mandate, or in the month that follows in the event of sudden cessation of this mandate.

VI-The association referred to in I of article L. 513-3 shall notify the organisation of any withdrawal of membership by its members in the categories referred to in 1°, 4° and 6° of article R. 511-2 within one month of such withdrawal.

VII -The organisation will remove its members from the register at the request of the Autorité de contrôle prudentiel et de résolution, pursuant to 6° of Article L. 612-41 of the Monetary and Financial Code. If the intermediary or intermediary acting on an ancillary basis can no longer demonstrate compliance with the obligations required for the category or categories under which he or she is registered, the AMF will cancel the intermediary’s registration and, where applicable, remove him or her from the register.

The AMF will notify the intermediary concerned by registered letter with acknowledgement of receipt of the deletion or withdrawal of registration within fifteen days of the decision in question.

The removal of the intermediary’s registration will be made public at the same time by the AMF, which will also notify the office of the clerk of the court in whose jurisdiction the intermediary is registered in the Trade and Companies Register.

VIII – The body will send the Minister for the Economy an annual report on registrations and deregistrations and on statistics relating to use of the register.

Article R512-5

I.-L’immatriculation et l’inscription sont effectuées dans un délai maximum de deux mois à compter de la date de la réception par l’organisme d’un dossier complet. L’organisme notifie au demandeur une attestation comportant son numéro d’immatriculation au registre et la date d’enregistrement.

II.-Lorsqu’il ressort de l’examen du dossier complet que la demande d’inscription ne satisfait pas aux dispositions du présent code, l’organisme prend une décision de non-inscription qu’elle communique au demandeur, par lettre recommandée avec avis de réception, dans le délai prévu à la première phrase du I du présent article.

III.-L’immatriculation est à renouveler annuellement selon des modalités fixées par arrêté du ministre chargé de l’économie.

IV.-Les intermédiaires et intermédiaires à titre accessoire informent l’organisme de toute modification des informations les concernant et de tout événement pouvant avoir des conséquences sur leur inscription, tels que le changement de lieu d’exercice professionnel, la cessation d’activité ou la radiation du registre du commerce et des sociétés. L’information est transmise dans le mois qui précède l’évenement, ou quand il ne peut pas être anticipé, dans le mois qui suit.

V.-La personne qui a délivré un mandat à l’un des intermédiaires ou intermédiaires à titre accessoire relevant des catégories mentionnées aux 2°, 3° ou 4° du I de l’article R. 511-2 notifie à l’organisme le mandat ainsi délivré dès sa prise d’effet, ainsi que la cessation de fonction de cet intermédiaire ou intermédiaire à titre accessoire dans le mois qui précède la fin du mandat, ou dans le mois qui suit en cas de cessation soudaine de ce mandat.

VI.-L’association mentionnée au I de l’article L. 513-3 notifie à l’organisme tout retrait d’adhésion de ses membres relevant des catégories mentionnées aux 1°, 4° et 6° de l’article R. 511-2 dans le mois qui suit ce retrait.

VII.-L’organisme procède à la radiation du registre, sur demande de l’Autorité de contrôle prudentiel et de résolution en application du 6° de l’article L. 612-41 du code monétaire et financier. Lorsque l’intermédiaire ou l’intermédiaire à titre accessoire ne justifie plus du respect des obligations requises pour la ou les catégories au titre de laquelle ou desquelles il est inscrit, l’organisme procède à la suppression de l’inscription et, le cas échéant, à la radiation du registre.

La radiation ou la suppression de l’inscription sont notifiées par l’organisme à l’intermédiaire concerné, par lettre recommandée avec avis de réception, dans le délai de quinze jours suivant la décision en cause.

La radiation est rendue publique concomitamment par l’organisme, qui la communique également au greffe du tribunal dans le ressort duquel l’intermédiaire est immatriculé au registre du commerce et des sociétés.

VIII.-L’organisme adresse au ministre chargé de l’économie un rapport annuel sur les immatriculations et les radiations intervenues, ainsi que sur les statistiques relatives à la consultation du registre.
